Meeting Minutes - Approved

April 23, 2009

Present: Ellen Baum, Paul Beltramini, Billie Oakes, Todd Woofenden, Brent Zachau

Meeting called to order at 7:00 p.m.

Zachau moved to accept minutes of 03-26-09. Oakes seconded and all voted in favor.

All members present signed Approval Letter for the Ireland (R07-001-A).

MacDonald – Application for a seasonal dock.

The applicant described the need for a small dock to reduce damage to shoreline vegetation and erosion of banks due to carrying canoes and kayaks from dwelling to water. The section above the high water line will be attached to 4x4 posts with 8”x8” wood pads (not mounted in the ground). Float will have 4x6 skids underneath to facilitate moving it into and out of the water. Winter storage will be on land nearby. Ramp segment will flip up onto the top segment, and that will hinge upward and remain in that position during the winter. Likely to be in placed between April and November. No trees will be cut. No post/footings will be mounted in the mud flats. There will be no creosote on materials. The dock will be of wood construction. A boundary marker is in place, and the dock will be located at least ten feet from the property boundary.

            Zachau moved to find the application complete. Beltramini seconded and all voted in favor.

Approval criteria:

  • Will maintain safe and healthful conditions.

Zachau made motion that the standard for this section has been adequately met based, because it will improve safety conditions. Beltramini seconded and all in favor.

  • Will not result in water pollution.

Zachau made motion that the standard for this section has been adequately because it will reduce sedimentation and environmentally safe materials will be used.  Beltramini seconded and all in favor.

  • Will not result in erosion or sedimentation to surface waters.

Zachau made a motion that the standard for this section has been adequately met because it will reduce erosion of the bank. Beltramini seconded and all in favor.

  • Will adequately provide for the disposal off all wastewater.

Zachau made a motion that this standard is not applicable because there will be no wastewater generated. Beltramini seconded and all in favor.

  • Will not have an adverse impact on spawning grounds, fish, aquatic life, bird or other wildlife habitat.

Zachau made a motion that the standard for this section has been adequately met because the size of the project is such that impact is minimized.  Beltramini seconded and all in favor.

  • Will conserve shore cover and visual, as well as actual, points of access to inland and coastal waters.

Zachau made a motion that the standard for this section has been adequately met because visual impact will be minimal.  Beltramini seconded and all in favor.

  • Will conserve natural beauty

Zachau made a motion that the standard for this section has been adequately met. Beltramini seconded and all in favor.

  • Will protect archaeological and historic resources as designated in the comprehensive plan

Zachau made a motion that the standard for this section is not applicable because none have been identified in the comp plan. on this property. Beltramini seconded and all in favor.

  • Will not adversely affect existing commercial fishing or maritime activities in a Commercial Fisheries/Maritime Activities district.

Zachau made a motion that the standard for this section is not applicable because the property is not located within the Commercial Fisheries/Maritime Activities District. Beltramini seconded and all in favor.

  • Will avoid problems associated with flood plain development

Zachau made a motion that the standard for this section has been met based on the finding that the proposed project is a temporary dock. Beltramini seconded and all in favor.

  • Is in conformance with the provisions of Section 15, Land Use Standards

Zachau made a motion that the standard for this section has been adequately met based on the finding that the proposed project meets the standards of both the Land Use Regulation & Shoreland Zoning Ordinance. Beltramini seconded and all in favor.

Conditions of approval:

  • BMP for erosion control shall be used during construction/until vegetation has returned to disturbed area where footing is being installed.
  • Dock will be at least ten feet from the boundary.

Zachau moved to approve the application with the two conditions listed. Beltramini seconded and all voted in favor.
