PLANNING BOARD MINUTES

August 23, 2012

 

Members Present: Paul Baines, Bill Shippen, Ellen Baum, Brent Zachau, Nate Drummond and Paul Beltramini.

                          

Others Present: Nicole Briand (Director of Planning & Development), Jenna Pierce (Secretary), James Thibeault, Vince Thibeault, Kevin O’Farrell, and Jenny Yasi.

Due to the length of the meeting minutes, the Board agreed to table this item until the next meeting in order to have more time to review.

 

Item 3:              New Business

 

Site Plan Review Tier II Application

Applicant: James Thibeault

Property: Tax Map R02, Lot 53

Project Description: Use existing three bay garage for small auto body repair and paint facility. 

 

Mr. Thibeault provided the Board with details regarding his plan to open a small auto body repair and paint facility. He will be doing minor auto body repair (primarily rust repair) and undercoating.

 

The Board reviewed the application to determine if it is complete. Beltramini indicated that there was additional information that needed to be provided. Mr. Thibeault indicated that he was aware that there were application deficiencies, but he was looking for the Board to determine what they would require for supporting information/documentation and have the final application ready for the next meeting.

 

Drummond asked Mr. Thibeault if a fire safety system would be added. He indicated that the garage currently exists and does not have a system installed yet. He has had pricing done for the installation of one, but he didn’t want to waste any money if the application didn’t pass. 

 

In order for the Board to determine if the application is complete, they need additional materials to be submitted with the application. Briand suggested that the Board review the checklist and the waiver requested list submitted by the applicant to determine what is needed and if any waivers should be requested.

Beltramini asked about the location of the floor drain. Applicant indicated that it was in the addition to the garage, but was unaware of where the drainage went (he would find out).

 

Applicant has been working with the State Fire Marshall regarding a sprinkler system. They are looking at a 4 head sprinkler system and State inspection minimum is 6. Beltramini suggested applicant have Fire Chief review plan.

Briand asked the Board about a site visit. The Board felt that one should be scheduled for next month, along with a public hearing to take place after. The Board agreed to a site visit at 6:00 p.m. and a public hearing to take place at 7:15 p.m.

 

Site Plan Review Tier II Application

Applicant: Kevin O’Farrell

Property: Tax Map R03, Lot 44-F

Project Description: Used car/repair garage including sales, service and state inspections on vehicles and motorcycles.

 

Mr. O’Farrell provided the Board with details regarding his plan to open a used car/repair garage, including sales, service, and state inspections on vehicles and motorcycles. His work will not include oversized vehicles. He currently plans to do this on the side for now, but if the business should grow, he wants to obtain approval now. He has been state certified to inspect motorcycles.

 

The Board reviewed the application to determine if it is complete. Beltramini indicated that the applicant should add to the application that he would not be doing work on heavy equipment. Baines asked about tire storage and the applicant indicated that as he buys tires, the old ones are taken away (storage time would be minimal). Baum asked about neighbors and the applicant said that his site is 12 acres in the woods. He has no intentions of putting up a sign, but may within the next 5 years. Applicant indicated that he would work with one of his neighbor who currently has a sign at the end of the road.

The Board discussed with the applicant his plan regarding the number of vehicles to be stored on the property. The current plan does provide for 10-15 cars, but the Board suggested that the applicant propose a number that allows for growth so that he would not need to come back before the Board. Applicant plans to only work on 2 cars at a time, but will add 20 cars to the application so that he covers himself.

 

Brian asked the Board about a site plan visit. The Board felt that one should be scheduled for next month, along with a public hearing to take place after. The Board agreed to a site visit at 5:00 p.m. and a public hearing to take place at 8:00 p.m.

 

 

 

Item 4:              Other Business

  • Request for Shooting Range Standards

 

Jenny Yasiwas present to discuss with the Board her concerns/issues with a neighbor who currently has a firing range on the Carding Machine Road. Yasi said that her neighbor is firing in the direction of her field where she trains dogs. For safety reasons, she felt that Board should consider guidelines for firing ranges and perhaps develop a committee to address the issue. Jenny indicated that there are currently gun safety ordinances in other towns and the NRA has regulations concerning firing ranges.

 

The Board discussed if this was a Planning Board or Selectboard issue. Briand said that the Selectboard asked the Planning Board to look into creating a set of performance standards for shooting ranges. Beltramini suggested that further research would be needed such as looking into the laws and what other towns have for ordinances regarding discharging guns. An issue that would need to be considered is the enforcement of gun control. The Town does not have town police and no contract with the Sherriff’s Department.

 

 

  • Annual Ordinance Review

 

Briand brought to the Board’s attention some issues with the ordinance:

 

  1. Briand raised an issue in the ordinance concerning the $500 application fee for a Tier II application. It is expensive for small businesses starting up. Briand wanted the Board’s feedback to see if a lower fee or hardship threshold/exemption could be given. Baines felt that the application fee covers her time for working on an application.

 

  1. Beltramini indicated that the ordinance only refers to outside dog kennels and play areas and currently doesn’t provide for cats.

 

  1. Shoreland Zoning. There were some revisions made in Augusta that are optional and the Board should review.

 

  1. One of the standards for a home-based business is that the business is inside.

 

  1. There are additional items to address in October when the Board has more time to review.

                        The next meeting will consist of two site visits and two public hearings on September 27th.
