Ordinance Regulating Mobile Homes and House Trailers

ARTICLE IV.

ORDINANCE REGULATING

MOBILE HOMES AND HOUSE TRAILERS

Section 1-401. Regulation 

No person shall maintain and occupy a mobile home or house trailer either singularly or in a trailer park in the Town of Bowdoinham, Maine, unless the following provisions are met: 

a.            Each mobile home shall be on an individual plot of ground, the area of which shall not be less than one acre. 

b.            If located on a public way at least 150 foot frontage shall be provided. 

c.            No mobile home or house trailer shall extend closer than 50 feet to the public way. 

d.            A continuing supply of safe and sanitary water shall be provided. 

e.            An adequate electrical power service shall be provided. 

f.            An adequate separate sewage disposal means shall be provided for each residence. 

g.            All provisions of the Article shall comply with State of Maine regulations. 

h.            The provisions of this Article shall not apply to any mobile home or house trailer located in the Town of Bowdoinham prior to the adoption of this ordinance. 

Section 1-402. Permit
 
No person shall construct, maintain, operate, locate or alter any mobile home or house trailer in the Town of Bowdoinham, Maine, unless such person shall first obtain a permit issued by the Building Inspector.
 
A.            Application 

The application for a permit shall be submitted in writing to the Building Inspector or the Town Manager. 

B.            Permit Approval 

The Building Inspector, after proper examination of the application, shall either issue the requested permit or transmit notice of refusal within ten days.  Notice of refusal shall be in writing and shall state reasons therefore. 

C.            Life of Permit 

All permits shall be void unless work thereunder is commenced within one year of the date of issuance. 

D.            Display of Permit 

Every permit shall be displayed in a conspicuous place on the premises, clearly visible for the principal traveled street, and shall not be removed until all work covered by the permit has been approved. 

Section 1-403. Pot Burners 

This section shall prohibit the pot burner type of heating for use in mobile home trailers, and any replacements shall be gas type only. 

Section 1-404. Violations and Penalty 

Any violation of the provisions of this Article or any permit issued by the Building Inspector shall be considered a nuisance, and the Building Inspector or Town Manager shall notify in writing the person responsible for the viola­tion.  Any person found guilty of' violating any provisions of the Article shall be subject to a fine of not more than $100.00 for each offense to be recovered on complaint for the use of the town of Bowdoinham.  Each day in which a violation is proved to exist shall constitute a separate offense.  All fines so assessed shall be recovered for the use of the Town of Bowdoinham through the District Court. 

Section 1-405. Appeal 

The Board of Appeals may, upon written request of an aggrieved party and after public notice, hear appeals from determinations of the Building Inspector in the administration of this Article.  Such hearings shall be held in accordance with State law.  An appeal may be taken after any decision is rendered by the Board of Appeals, by any party to Superior Court in accord­ance with State law. 

The fee for a building permit shall be in accordance with the following chart:

Any work not fitting into the above categories     $10 building permit fee 

New buildings and additions are measured on the exterior.

Interior work is calculated by measuring the affected area in the building.
