Minutes of Select Board Meeting
September 9, 2008

Residents present: Daniel Billings, George Christopher, Dorothy Baker, Tony Cox, Paul Baines, Kathy Durgin-Leighton

Non residents: Darcie Moore, Times Record and Jim Phillips, Assessor

Item 1: Call the meeting to order – The Chair called the meeting to order at 6:30 pm. All members were in attendance: Selectperson Whittlesey, Selectperson Dorr, and Chair Ciembroniewicz.

Item 2: Consideration of the minutes from August 26, 2008 meeting – The Board reviewed the minutes. Selectperson Dorr moved to accept the minutes as written, seconded by Selectperson Whittlesey. The vote was 3-0 in favor.

Item 3: Comments from the Public – There were no comments from the public.

Item 4: Town Manager’s Report

A. Court Decision regarding State vs. Sara Dolan (Theft by Deception charge) -
Ms. Dolan appeared before the Sagadahoc Superior Court on Thursday, September 4, 2008. The Town Manager outlined the terms of Ms. Dolan’s sentence in return for her guilty plea. The Manager reported that she was satisfied with the resolution and that the Town would receive full restitution of $6,350.

B. Fuel/Diesel Bid results – The Manager reported on the results of the fuel bids received and accepted on September 5, 2008:

C. Hiring of an Election Clerk – The manager requested that the town hire a temporary election clerk to assist the Town Clerk with the upcoming presidential election. Money is available in the budget as a part time position has not yet been filled. Selectperson Dorr moved to hire a temporary election clerk for the period October 6 through November 5, seconded by Selectperson Whittlesey. The vote was 3-0 in favor.

Item 5: New Business

A. Meeting with Paul Baines for consideration of appointment to Planning Board as an Alternate Member – The Board met with Mr. Baines regarding his interest in the appointment to the Planning Board as an Alternate Member. Mr. Baines currently volunteers his time on the Land Use Revision Group’s Village District subcommittee. A brief discussion followed regarding his experience with the Bowdoinham Planning Board that he characterized as very positive. The Board informed him that a decision would be made at a later meeting since there was another candidate interested in the same position.

B. Meeting with Jim Phillips, Assessing Agent – Mr. Phillips reported that he had made a few key punch errors that resulted in significant tax abatements for a few residents. The key punch errors resulted when changing property acreages to the GIS data provided by the town’s mapping company, Spatial Alternatives. With many acreages changed, he made a few key punch errors. Abatements have been given to correct the errors. The goal was to improve the accuracy of the acreage by using the GIS data. Mr. Phillips believes that the GIS data has improved accuracy in some cases. If properties have been surveyed or if deeds can provide proof that the GIS data is incorrect, he will make revisions. By using the GIS data, the overall total acreage in the town changed by 125 acres or 1% of the total town acreage. The problem is that most of the acreage that the town had been using for tax purposes came from inaccurate sources such as old deeds. The Assessing Clerk is now reviewing the acreages to determine if there are any that deviate more than 10%. Mr. Phillips reported that the Assessing Office will be developing a field in the data to denote where the acreage numbers came from i.e. survey, deed, GIS, etc.

C. Municipal Valuation Return – The Board reviewed the Return with the Assessing Agent. The Board executed the document.

Mr. Phillips reported that the town’s certified ratio, set by the state, is currently at 90.2%. This number is determined by comparing the data from the recent sales of properties to the assessed value. The Town of Bowdoinham is at 80.2 %; towns are required to be at 70% or better. Since towns are allowed to add 10% to the ratio, Bowdoinham’s certified ration is 90.2%. The last time the town had a full reevaluation was in 1991. Mr. Phillips believes that the Town’s data is reasonably good at this time.

D. Celebrate Bowdoinham update – Tony Cox, Community & Economic Development Director – Mr. Cox gave an update of the day’s events.

Item 6: Old Business
The Board noted that its August 26, 2008 meeting minutes needed clarification to Item 5. A Dangerous Buildings Update. Due to improper notice, Selectperson Dorr moved to rescind the Board’s motion to instruct the Code Enforcement Officer to prepare findings ordering Mr. & Mrs. Laroche to bring the barn found to be unsafe by the Board of Selectpersons into compliance by December 1, 2008, seconded by Selectperson Whittlesey. The vote was 3-0 in favor.

Item 7: Selectperson’s Request for Agenda Items for next meeting (September 23, 2008)

Item 8: Consent Items

A. Assessing Agent Property Tax Abatement requests for the following:

Chattley, James B & Helen M., 167 White Road, Bowdoinham, Me - $1,480.00 – Correct Previous Abatement – Selectperson Dorr moved to approve the abatement of $1,480.00 due to an error by the Assessing Agent, seconded by Selectperson Whittlesey. The vote was 3-0 in favor.

Item 9: Consideration of Treasurer’s Warrants #13, 14 & payroll 8/28/2008 – The Board reviewed the Treasurer’s Warrants.

Selectperson Whittlesey moved to approve the 8/28/2008 payroll warrant, seconded by Selectperson Dorr. The vote was 3-0 in favor.

Selectperson Whittlesey moved to approve the Treasurer’s Warrant #13, seconded by Selectperson Dorr, The vote was 3-0 in favor.

Selectperson Whittlesey moved to approve the Treasurer’s Warrant #14, seconded by Selectperson Dorr, The vote was 3-0 in favor.

Item 10: Announce Future Meetings, Workshops, Events

• September 18 @ 6:30 pm – Land Use Planning Group – Nutrient Management (sludge, manure)
• September 23 @ 6:30 pm – Regular Select Board meeting
