Minutes of Select Board Meeting
November 25, 2008

 

Residents in Attendance: David Berry, Kathy Durgin-Leighton, Town Manager


Item 1: Call the meeting to order – The Chair called the meeting to order at 6:30 pm. Chair Ciembroniewicz and Selectperson Whittlesey were in attendance.

Item 2: Consideration of the minutes from November 10, 2008 meeting – Tabled until next meeting

Item 3: Comments from the Public – There were no comments from the public.

Item 4: New Business

a. Meeting with Tax Assessing Agent, Jim Phillips – Tabled until next meeting.
b. Consideration to accept gift of $2,500 from Wal-Mart Foundation to the Bowdoinham Fire Department – The Town Manager reported that the funds were an unsolicited gift to the Fire Department from Wal-Mart. Selectperson Whittlesey asked if the manager knew if other towns received similar funds from Wal-Mart and if Wal-Mart had any outstanding business with the town. There is no outstanding business with the Town however in regard to other towns receiving similar funds; she would get back to the Board with the information at the next meeting. Selectperson Whittlesey moved to accept the funds on behalf of the Fire Department, seconded by Chair Ciembroniewicz. The vote was 2-0 in favor.
c. Consideration to accept gift of $250 from Wal-Mart Foundation to the Bowdoinham Recreation Department. Selectperson Whittlesey moved to accept the funds on behalf of the Recreation Department, seconded by Chair Ciembroniewicz. The vote was 2-0 in favor.
d. Consideration to name private road Small Way – The Manager reported that the private road began as a driveway and through the years, three homes had been built off of the original driveway. For 911 purposes, the road needs to be named and addresses assigned. The residents on the road selected “Small Way”. Selectperson Whittlesey moved to accept the road name of Small Way, seconded by Chair Ciembroniewicz. The vote was 2-0 in favor.
e. Consideration to approve Quit Claim Deed without covenant between Town of Bowdoinham and Philip A. Densmore, Trustee of the Philip A. Densmore Revocable Trust – The Manager reported that multiple liens had been placed on the property in the 1970’s and 1980’s for non payment of property taxes. Neither records nor receipts could be found to show that the liens had been paid within the 180 day period before the property went into automatic foreclosure though records were available to show that the taxes had been paid yearly since the late 1980’s. Without the records available, a Quit Claim Deed needed to be signed by the Board. The Board executed the Quit Claim Deed on behalf of the Town.

Item 5: Old Business – There was no old business.

Item 6: Town Manager’s Report

a. Setting Christmas Holiday schedule – The Manager reported that typically the employees receive two days of paid holiday time at Christmas. Since Christmas fell on a Thursday, the employees wished to take Friday off. The manager recommended that the employees receive both Thursday and Friday as paid holiday time and that the town office close on Christmas Eve at noon with the employees taking 5 hours as vacation time. The Board approved the recommendation.
b. Report on collections of FY09 property taxes – The Manager submitted reports on the FY09 real estate property tax not paid for the first half, the FY08 properties currently in lien, and the FY07 properties that are in danger of foreclosure.

Item 7: Selectperson’s Request for Agenda Items for next meeting (December 9, 2008)

Item 8: Consent Items – There were no consent items.

Item 9: Consideration of Treasurer’s Warrants #20 – The Board reviewed the Treasurer’s Warrant - Chair Ciembroniewicz moved to accept Treasurer’s Warrant #20, seconded by Selectperson Whittlesey. The vote was 2-0 in favor.

Item 10: Consideration to enter into executive session pursuant to 1 M.R.S.A. § 405 (6) (A) to discuss Personnel Matters – Selectperson Whittlesey moved to enter into executive session pursuant to 1 M.R.S.A. § 405 (6) (A) to discuss Personnel Matters, seconded by Chair Ciembroniewicz. Selectperson Whittlesey moved to exit from executive session pursuant to 1 M.R.S.A. § 405 (6) (A) to discuss Personnel Matters, seconded by Chair Ciembroniewicz. No actions or decisions were made during executive session.

Selectperson Whittlesey moved to reconvene the Solid Waste Study Committee and to include the two citizens who had expressed interest in serving on the permanent Solid Waste Committee to look at the Solid Waste program in light of the declining revenues for recyclable materials, seconded by Chair Ciembroniewicz. The vote was 2-0 in favor.

Item 11: Announce Future Meetings, Workshops, Events

• November 27 & 28 – Town Office Closed for Thanksgiving holiday
• December 4 @ 6:30 pm – Shoreland Zoning Public Meeting
• December 9 @ 6:30 pm – Select Board Regular Meeting
• December 11 @ 6:30 – Finance Advisory Meeting – Rob Snowe, Maine Bank & Trust
• December 8, 9, & 10 – Financial Audit for FY08
• December 10th – Foreclosure notices sent

Item 11: Adjournment – The Chair adjourned the meeting at 9:00 pm.
